Subdivision Administration

The Land Use Planning and Zoning Department (LUPZ), Subdivision Administration Team manages Tribal lots within the Gila River Indian Community. Tribal lots within the Community are referred to as homesites. The Subdivision Administration Team performs its duties in accordance with the Land Use Chapter 2 Homesite Ordinance adopted and effective October 01, 2018. The Community Council finds that providing Homesites on Reservation land has a direct effect on the health and welfare of the Community and its members and is an action taken pursuant to the inherent powers of the Community to exercise civil authority and to provide for the welfare of its members. The Community Council intends for the revised Homesite Ordinance (GR-004-18) to govern the provision of Homesites and Residential Leases on both Community and Allotted trust land within the exterior boundaries of the Gila River Indian Reservation. The Community Council further intends that this ordinance requires that Community members and non-Community members abide by the Homesite Ordinance and disclose all relevant information to the Community in the assignment of Homesites.

Subdivision Administration Team duties include:

  • Documenting applications and application fees for homesite requests and providing assistance to Community members in preparing applications.
  • Managing and updating homesite assignments
  • Conducting annual inspections of all Tribal Homesites, once-a year, to check for compliance.

Helpful Information
  • Tribal Homesite Agreements must be updated annually with the Department of Land Use Planning & Zoning, Administration Team to ensure information is accurate, such as address, phone numbers and beneficiary information.
  • If an Assignee is going to be away for sixty (60) consecutive days, they must provide LUPZ Subdivision Administration Team with adequate justification to avoid Homesite being declared abandoned.
  • The raising of livestock on a Homesite and a Residential Lease is permitted provided that a total of five shall be the maximum of livestock permitted per on half (1/2) acre lot area.
  • A Homesite assignee may make an application with the Department of Land Use Planning and Zoning to construct a second dwelling for any member of their immediate family.
  • Community members shall only have one Homesite assignment regardless if the assignment is on tribal or allotted land.
  • If a Homesite assignee is married to a Community member the Homesite will be considered to be assigned to both spouses. Married spouses can only have one Homesite. Annual updates are required to ensure current data is updated for contact purposes.
  • Members who fail to update may be required to start the process over and be placed on the end of an updated waiting list.
  • Community members are allowed to apply for only one Homesite, which can be in any district.
  • Any enrolled member of the Gila River Indian Community as defined in Article III, Section 1 of the Constitution and Bylaws of the Gila River Indian Community (1960) may receive a homesite assignment subject to the conditions listed in the Land Use Chapter 2 Homesite Ordinance GR-004-18
